NRI Guide: Buying Property in Pondicherry from Abroad
What Non-Resident Indians can buy, how to pay, how a power of attorney works, and how to manage the property once you own it.

Many Pondicherry families have members living in the Gulf, Singapore, Europe or North America who want to buy a home or plot back home. The process is very manageable from abroad, as long as you follow a few rules.
What NRIs can and cannot buy
Under India's foreign exchange rules, Non-Resident Indians (NRIs) and Overseas Citizens of India (OCIs) can generally buy:
- Residential property: flats, independent houses, villas and residential plots.
- Commercial property: shops, offices and commercial buildings.
They generally cannot buy agricultural land, plantation property or farmhouses. They can, however, inherit such property. If you are looking at land, confirm its classification before you go any further.
How to pay
Payment must come through normal banking channels:
- From your NRE, NRO or FCNR account in India, or
- As an inward remittance from abroad into the seller's account.
Payments in cash, or directly in foreign currency, are not allowed. Keep every bank record. You will need them later for tax and, if you ever sell, for sending the money back abroad.
Buying without travelling: power of attorney
You do not have to be in India for the registration. Many NRIs give a power of attorney (PoA) to a trusted family member or representative here. In practice:
- The PoA is drafted to cover this specific purchase.
- You sign it abroad and have it attested at the Indian embassy or consulate (or apostilled, depending on the country).
- Once it reaches India, it generally needs to be stamped within a limited time (usually three months) before it can be used.
Keep the PoA as narrow as possible, for example limited to one named property, and cancel it once the work is done.
Documents you will need
- Passport and visa / OCI card
- PAN card, which is needed for property registration and tax filings
- Overseas address proof and passport-size photographs
- Bank statements showing the source of the payment
Before paying, carry out the same title checks as a resident buyer. See our checklist of documents to verify before buying a plot.
Tax
Tax deduction at source (TDS) applies to many property transactions, and the rules differ depending on whether the seller is a resident or an NRI. Rental income and capital gains on Indian property are taxable in India. Speak to a chartered accountant before buying so the deal is structured correctly.
Looking after the property once you own it
The real challenge for most NRIs is not buying but maintaining the property: paying property tax and electricity bills on time, keeping the land fenced and free of encroachment, handling tenants, and keeping the patta and other records updated.
This is where a local property manager helps. Thirumalai Properties offers NRI property management in Pondicherry, so you have someone on the ground who can visit, report back and deal with the paperwork.
