Registration is the step that legally makes you the owner. Until the sale deed is registered at the Sub-Registrar's office, the property is not yours, however much you have paid. Here is how the process normally runs.
Step 1: Verify the documents
Before anything is drafted, verify the title, Encumbrance Certificate, patta and approvals. Our document checklist for buying a plot covers what to look at.
Step 2: Sale agreement
Buyer and seller usually sign a sale agreement first. It records the price, the advance paid, the timeline for the final payment and what happens if either side backs out.
Step 3: Drafting the sale deed
The sale deed is the document that is registered. It sets out the parties, the full property description (survey number, extent, boundaries), the price and how it was paid, and the history of the title. It is prepared by a licensed document writer or an advocate. Mistakes in the property description are hard to correct later, so check every number.
Step 4: Stamp duty and registration fee
Stamp duty and the registration fee are calculated on the guideline value (the government's minimum value for the area) or the actual sale price, whichever is higher. They are paid before or at the time of registration. Rates change from time to time, so confirm the current figures before you budget.
Step 5: At the Sub-Registrar's office
On the registration day:
- The buyer and seller (or their power-of-attorney holders) must be present.
- Two witnesses with ID proof are needed.
- Bring original ID proofs, PAN cards, photographs and the original parent documents.
- Both parties' photographs and fingerprints are captured, and the officer checks the deed and identities.
Once the deed is registered, it is scanned and the original is returned, usually the same day or soon after.
Step 6: After registration
Registration makes you the owner, but your work is not finished:
- Patta transfer (mutation): apply to have the revenue records changed to your name.
- Property tax: have the tax records and assessment transferred to you.
- Electricity and water: transfer the service connections, if any.
- Fresh EC: after a few weeks, take a new Encumbrance Certificate to confirm your purchase appears on record.
Keep the registered deed, the receipts and the parent documents together and safe. You will need them for loans, building permission and any future sale.
